General Information & Warranties

Ordering

Martin Universal Design, Inc., requires all orders to be in writing to ensure the accuracy of the order. Kindly mark clearly the quantity of each model ordered in the space provided. In the event an order is placed by telephone, shipping will be delayed until receipt of written confirmation of the order. Orders totaling less than .00 net are subject to a service charge of .00.

Terms of Sale

Our terms are Net 30 Days from the date of invoice, upon credit approval. All past due accounts are subject to a service charge of 1.5% per month (18% annually). Martin Universal Design, Inc. reserves the right to delay or cancel shipment of customer’s order in the event the customer’s account is past due. Past Due Invoices do not qualify for freight allowance.

Applicable Prices

Prices in our price lists are MSRP, (Manufacturers’ Suggested Retail Prices) and are subject to change without notice or approval. Prices do not include any Federal, State or other taxes, which may now or hereafter be applicable to the sale of Martin Universal Design, Inc. products.

Shipping & Delivery

Unless otherwise specified, all orders are shipped F.O.B. Martin Universal Design, Inc. 4444 Lawton Avenue, Detroit, Michigan. In the absence of customer’s specific instructions, Martin Universal Design, Inc. will determine the method of shipment, routing and carrier. Additional expense resulting from customer’s request for special shipping method and/or routing will be at the customer’s expense. Martin Universal Design, Inc. will not be liable for delay in shipment, delivery of the order or damages claimed to result from such delay. Customer bears risk of loss or damage during shipment, since responsibility passes to the customer upon delivery to carrier from Martin Universal Design, Inc., Martin Universal Design, Inc. will not participate in any settlement of claims for concealed damage except in the case of F.O.B. destination shipments. In the case of F.O.B. destination shipments, customer must: (1) unpack immediately to inspect for damage, and if discovered, (2) not to move product from point of examination, (3) retain shipping container and packing materials, (4) notify carrier’s agent to make inspection, and (5) send Martin Universal Design, Inc. a copy of the carrier’s inspection report. Shortages must be reported to the carrier for correction. Claims against Martin Universal Design, Inc. for shortage or error must be made within 48 hours of date of delivery to the customer or all rights to make such claim shall be considered waived. If UPS or Fed Ex damage occurs to cartons/product, customer must notify Martin Universal Design, Inc. within 24 hours of receipt of merchandise.

Changes of Orders

Request for product changes must be made by telephone within 24 hours after receipt of order and is subject to Martin Universal Design, Inc.’s approval. Changes should be confirmed in writing to ensure complete accuracy.

Limited Warranty

Martin Universal Design, Inc. warrants its standard product products, with the exception of fabric and customer’s own material, and Neolt trims, to be free from defects in material and workmanship for a period of 1 year. All warranties apply only to products acquired directly from Martin Universal Design, Inc. or others authorized to sell such products. Martin Universal Design, Inc.’s obligation and customer’s remedy pursuant to this warranty extend only to the repair or replacement, at Martin Universal Design, Inc.’s option. This remedy is expressly agreed to be exclusive of all other remedies and damages, including incidental consequential damages. The warranty does not apply to damage resulting from accident, alteration, misuse, tampering, negligence, or abuse. Any Item manufactured and applied to Martin Universal Design, Inc. product carries the subcontractor’s warranty only. Because of natural variations over which Martin Universal Design, Inc. has no control, this warranty does not extend to color or grain. There are no other warranties, either expressed or implied which extend beyond the description as expressly stated in the limited warranty paragraphs, including the warranty of merchantability or fitness for any particular purpose. No person, firm or corporation is authorized to assume for Martin Universal Design, Inc. any liability in connection with the sale of Martin Universal Design, Inc. products, except as set forth in the warranty paragraphs, regardless of the theory upon which any claim might be based.

Return Policy

Any and all returns are subject to a 20% restocking charge and are only allowed during the first 30 days after shipment. An RGA (Return Goods Authorization) number must be requested in advance, If authorized, an RGA number will be issued and must be shown on the shipping label to be accepted by our receiving department. All returns must be in original packing and in resalable condition. We do no provide inventory adjustment or rebalancement service.
